TERMS AND CONDITIONS

Last updated 31 August 2021. These terms and conditions apply to all use and transactions carried out on gamervit.co.uk. Please read them carefully before you use the gamervit.co.uk site. We recommend that you print out a copy of these terms and conditions and keep them for your future reference. By using the gamervit.co.uk site you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, then please do not use the gamervit.co.uk site. In the following terms and conditions, the use of “our”, “us” and “we” means GamerVit Ltd. These terms and conditions do not affect your statutory rights.

1. YOUR ACCOUNT

It is your responsibility to keep your password and account name details secret. Please do not disclose them to anyone else, and ensure you take all reasonable precautions to prevent it becoming known to anyone else.
You agree to accept responsibility for any use of this site and any transactions that occur using your account name and password. If you become aware of, or suspect, any unauthorised use of your account you must inform us immediately by contacting security@gamervit.co.uk. If you know or suspect that your password has become known to anyone else, then please change it immediately and also inform us at security@gamervit.co.uk.  

2. CONTRACT FOR PURCHASE OF GOODS

You will be able to check or modify your order at any time up to the point when you press the submit order button. You will then receive an email from us detailing the products you have purchased and providing you with an order reference number. This email is confirmation of your offer to purchase a product or products from us; it does not constitute an acceptance by us to fulfil that order. Completion of payment does not constitute an acceptance by us to fulfil that order. We will send you a second email when we have dispatched the order to you. The sending of the email will signify that we have accepted your offer and complete the creation of a legally binding contract between yourself and GamerVit Ltd. Any products which are part of this order but are not included in the second email will not form part of this contract. We will send a separate dispatch email confirming a new contract for any further products we send out as part of the order. We retain the right to refuse all or part of an order for any reason up to the point at which the contract is made between us. If this is the case, we will inform you of the decision via email.

3. Subscriptions

What are the benefits of your subscription program? Not only will you receive a timely package to restock your supplies but you will also be making significant savings! When will I be charged? You’ll be charged automatically on the date the order is processed. How will I know when my subscription order is on its way? You can expect an order confirmation email each time an order is processed.  We’ll also send you an email as soon as your order ships so you you know when to expect your next pacakge. How Do I cancel? You have the right to cancel your subscriptions at any time and it will be terminated at that point with no further charges or deliveries.

4. DELIVERY

We aim to get all orders shipped the same day if placed before 2pm, otherwise will be sent out next day. We send all products out via Royal Mail 24 service in the UK. All UK orders include free shipping. Europe can be upto 5 working days delivery and is a flat £7.50 rate. Royal Mail Zone 1 is upto 7 working days delivery. Flat rate of £11.50 Royal Mail Zone 2 is upto 14 working days delivery. Flat rate of £14.00 Royal Mail Zone 3 is upto 21 working days delivery. Flat rate of £16.00

5. REFUNDS AND RETURNS

Here at GamerVit, we pride ourselves on customer care.  So, if you do have an issue with a product you have purchased from us, PLEASE communicate with us.  We will do our best to resolve the issue. As a consumer you have the right to withdraw from the purchase of an item according to local and European Law within 14 (fourteen) days after the date the item is delivered. This applies to all items which are offered and purchased on this website. To withdraw from a purchase you must notify us by letter, fax or email to arrange collection of the item. There is no need to give any reason for the withdrawal however to exercise your right of withdrawal you must return the item in the same condition in which it was delivered to you within a 14 day period after giving notice. Please note that you are liable for the delivery costs of returning the item to us. Please send any request for withdrawal, with your details, to the

Email: returns@gamervit.co.uk If the withdrawal is made in the above manner, the purchase contract for the item is cancelled and we shall refund your money within 28 (twenty-eight) days from your notice. We will give you a full refund of the return charge, if you had to return the goods because of our mistake. These terms do not affect your legal statutory rights. All returned items must be unopened with their original seal intact.

6. AVAILABILITY OF GAMERVIT.CO.UK

We will do our very best to ensure that this website is available, and you are able to complete transactions without errors. However, as with all internet services, this is not always possible. If you do notice an error, then please email our technical department at webmaster@gamervit.co.uk. The service provided by gamervit.co.uk does not include providing the computer or any other equipment required to access the gamervit.co.uk site. We are not liable for any of the costs you may incur associated with your use of the gamervit.co.uk site and any transactions made with GamerVit Ltd. We may at times have to restrict access to the gamervit.co.uk site, or part of it, to allow for necessary upgrades and maintenance. We reserve the right to restrict access to the gamervit.co.uk site, and to refuse or cancel orders at our discretion. Should we do so, we will fully refund you.  

7. TRADEMARKS AND COPYRIGHT

All the material and content on the gamervit.co.uk website, including, but not limited to the logo, html scripts, images, buttons, and all other intellectual property are trademarks or trade dress of GamerVit Ltd. GamerVit Ltd retains the copyright to all of the material and content on the gamervit.co.uk site, except as detailed below. The copying in anyway, be it directly or indirectly, of the content and material of the gamervit.co.uk, is prohibited, unless for personal, non-commercial use, without the express permission of GamerVit Ltd. The law of copyright and its related rights can be found in the copyright sections of the Copyright Designs and Patents Act 1988 (as amended). The trademarks and copyright of any material or content on this site that is not the property of gamervit.co.uk, remain the property of their respective owners.  

8. LINKS

We may provide links on the gamervit.co.uk site that direct to other third-party websites. By linking to these sites, we are not guaranteeing them or make any judgement on the quality of their site. We are not responsible or liable for the content of these third-party sites, and your use of their products or services. You agree to be bound by the terms and conditions of any third-party sites which you access from the gamervit.co.uk site.

10. LIMITATION OF LIABILITY

We will not be liable in anyway, to the fullest extent permitted by law, in connection with these terms and conditions for any: 9.1 Economic losses (including without limitation business costs, loss of actual or anticipated profit or revenue)

9.4 Loss of opportunity
9.5 Loss or damage to or corruption of data
9.6 Loss of reputation that result from the use of this website, any orders made via this website, or any matter related to these terms and conditions. As with all aspects of our business we are always reasonable, and if you have any concerns, please do contact our customer services department. This clause does not exclude or limit our liability for death or personal injury that results from the gross misconduct of GamerVit Ltd or any of our employees when acting in a capacity for GamerVit Ltd.  

11. JURISDICTION

This agreement is governed by English law. As such you agree that shouldany dispute arise in anyway connected to these terms of use that youshall submit the resolution of the dispute to the jurisdiction of the English Courts. We provide no guarantees or warranties that the gamervit.co.uk website and its material and content comply with any other laws than those of England.  

12. GENERAL

11.1 You may not transfer any of your rights and responsibilities under these terms and conditions to another person.
11.2 All information and material on this site belongs to gamervit.co.uk who will not be responsible for any errors or omissions in the site. We make no warranties, whether express or implied in relation to the accuracy of the material and content of this site. GamerVit Ltd or any of its employees will under no circumstances be responsible or liable for any consequences of the use of this information. You use this site at your own risk, subject to our rights and responsibilities under this agreement.
11.3 If an event occurs which is beyond our reasonable control and its results in a breach of our obligations under these terms and conditions, then we cannot be held responsible.
11.4 We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.  

13. PRICES

All prices quoted are in United Kingdom pounds sterling and are inclusive of VAT. Changes to these terms and conditions may be made by GamerVit Ltd at any time. They will take effect immediately from the time they are
posted. Please ensure that you read the terms and conditions each time prior to placing an order, so that you are aware of the latest ones. We will also email all registered users to notify them of any changes in the terms and conditions. By continuing to use the gamervit.co.uk site you are indicating your agreement to be bound by the new terms and conditions.
